James Tyrrell the Money Drainer

The violent attacks carried out on September 11th consumed our country with terror. However, while some were fueled with anger and hatred, New Yorkers stood together and bravely exhibited generous acts of kindness toward one another, supporting and trying to rebuild the city that they love. In attempt to compensate the rescue workers that have risked their health and their lives working in and around the World Trade Center, the United States Congress put away a billion dollars in order to redeem the workers of all their hardships.

Seven years after the 9/11 attacks only one victim has received any compensation and only $45,000 out of a billion dollars has been used. These workers were exposed to toxic fumes and smoke that have caused serious health complications. Firefighters, police officers, iron workers and other construction site workers are now left with illness and injury after putting their lives on the line working for the people of New York. However, an appalling billion dollars of tax payer’s money is now actually going towards fighting against these rescue workers instead of for them. The man that is behind this operation is attorney James Tyrrell of the Patton Boggs Law Firm. The money that was intended to go to the rescue workers is now being used against them. As their health worsens and their wallets empty, James Tyrrell sits from above and continuously drains money from 9/11 heroes.

While the purpose and the people who were allocated the money was made clear originally, there still remains to be an evident and obvious misuse of the money and for some reason is being justified by James Tyrrell. Senator Schumer and Senator Clinton have both plainly stated that the correct use of the fund was to go towards those who have been injured valiantly aiming to clean up after the 9/11 attacks and not used in an unjust attack against them. Oddly, the media coverage regarding this issue has been scarce to non existent. Surely that once publicized, New Yorkers will not stand for this obvious violation of rescue worker’s rights and James Tyrrell will be known as an advocate of evil minded attempts against the city and people of New York.

Resignation by Government Duly Electged

Time has come when we should think over the subject and we should examine whether a government duly elected can tender resignation mid-way or whether the people in the government or in alliance can withdraw from the alliance and thus compel the government to resign because it goes in minority. These are important question in a democratic set up because in a democracy people are the real masters and all those whoa re elected or appointed are merely public servants. The public servants should not be allowed to dishonour the verdict of the people which they have given and they have allowed a government to function in the country for the prescribed period. Elections should not allowed to be conducted before the expiry of the tenure.

Here in India we had got a family rule and we tolerated the same though such a rule is totally foreign to a democracy. Then we had got a party dictatorship which is also no allowed in a democracy and then we had been under individual autocracy and we had suffered much. Then the people of India could adopt another idea and they introduced this alliance system, but this alliance system has got so many troubles with us and one day we shall change this concept too because the political parties coming in alliance are not honouring the people of India and their verdict. Once the people have given them an opportunity they must remain in office till the tenure is over and there should be no mid-way breaking away.

Here in India the present government is going down in minority because one party has already withdrawn and some other left groups are threatening to withdraw. This withdrawing system is not allowed under the constitution of India. Once they have joined in the alliance, they must continue in the alliance for full term of five years and they must not be allowed to withdraw. If there is no law, we should enact such a law under which people coming in the alliance must know that their entry had been sanctioned by the people to whom they are serving and they should accept the verdict of the people i.e. the masters and they should remain in alliance till final date of tenure.

Governments are elected by the people and only then they are allowed to have seats in the houses and they should not be allowed to leave the house at their own sweet will. They are public servants and they have occupied these seats of power and till the people desire they should remain serving the people and till the next date of elections. They must work because when these threats are there, the government functioning stops and people who are the masters suffer because of mischief of some members in the house. They must serve because they were elected, appointed and given wages for their work and they have got no will of their own.

People of India and that of the world must examine this question because such situations are also there in other countries and India is not an exception. Therefore, the people must come forward and tell the people in the houses that they are not having any independence. Once they are in and the people have given them recognition, they should obey the orders of the masters and they should wait till the next general election.

The people in the houses must know that elections in India is not an easy task. Huge amounts are spent on elections and if we go deep so many people are killed in each elections. And the people also suffer because the election process in India is cumbersome and costly. We have to spare time, money, energy and all that we have to hear much about the people who are standing in elections. No one should be allowed to waste time of the people and the public servants must behave like servants and they should be allowed to function as masters of the country.

Kashmir Still With a Muslim Psychology

In 1947-48 a part of Kashmir had been occupied by India and a part of Kashmir went to Pakistan and because of certain international pressures both the countries could not finally merge these parts in their own countries and they have been maintaining separate identities of these two parts apart from India and Pakistan. India is claiming that whole of Kashmir is part of India but Pakistan says that Kashmir is a disputed territory and the people of Kashmir should be allowed to decide the final fat e of kashmir and that is the reason, these two parts are still going on with care-taker governments.
The government of India is not accepting the demand of plebiscite which had been decided by UNO because of the population problem because the majority in Kashmir are Mohamdans and there are chances that they may not be voting in favour of India. Even Pakistan is not very much certain that the people of Kashmir shall vote in favour of Pakistan and if there is plebiscite in Kashmir most of the Kashmiries shall vote for a separate Kashmir country.
The psychology of Kashmiries is now established when a piece of land which is lying un-utilized had been allotted to Amar Nath shrine Board by the government. This piece of land had been allotted to the Board so that they could construct temporary shelters for the devotees. This piece of land had already been utilised as such since long, but now the people of Kashmir and specially the political parties are not willing to cooperate with the state and they started agitating on the subject. Now they are claiming that the state is trying to bring Hindus to this area and thus in due course they shall be turning this state a non-Muslim state. The people who want a separate Kashmir have got only one point with them that they are a Mohamdan Majority state and therefore, one day they shall get independence and they shall be having a separate country. They are doubting the integrity of the state and they fear that the state is trying to turn this state into a non-Muslim-Majority state. And all the political parties established in Kashmir have joined the separatists and they are also asking the state to withdraw the order and there are chances that the state shall withdraw the order in due course.
What the state did and what the people are doing are points for consideration. Whether such courses are acceptable in a country like India who has declared itself as a secular state and we have adopted the concept of no discrimination on the basis of religions. When we are Indians first, the controversy which has taken birth in Kashmir shall give us new directions. If the state withdraws its order and does not allot the land to the Shrine Board, then it means they also accept that the Kashmir is a Muslim Majority state and even the state is not allowed to convert this state into a non-Muslim majority state. The present situation and decision on this point shall decide the future course of events in Kashmir. We are a secular state and therefore, we should not come down under such pressures because once we accept such a pressure, then in all other states we shall be facing such situations. In some states the Hindus shall be coming out with such demands and they shall be demanding that all Muslim shrines be demolished and transferred to other Muslim majority states.
This Amar Nath shrine had been located by a Muslim and therefore, the Muslims of Kashmir should help the Hindus to keep this shrine busy and that is possible only when the devotees are given due shelter and accommodation. The Hindus shall not be constructing pacca accommodations, but they should be allowed to construct katcha accommodation so that the transit system could be established in a right manner. The present Muslim psychology shall not help Muslims and they shall be loser in the near future. The Muslims of Kashmir should have some sympathy for the Muslims living in other parts of India and they should withdraw this agitation. India is a secular country and every one of us must try to keep this country a secular state and the Muslims of Kashmir should not raise objections that if some structures are raised, they shall be losing their Majority status in Kashmir. The people all over the world must come forward and give right direction tot he people of Kashmir who have initiated the present agitation.

That's an interesting question isn't it. Do men like fragrances, and would they like to be given a perfume as a gift?

The Pope’s Visit Reminds Us That There is Still a Lot of Work to Do

The Pope’s visit to New York City last week only reiterated the need for WTC rescue workers to begin receiving their rightful share of the $1 Billion that Congress set aside for them after the attacks of 9/11. Pope Benedict XVI, after a 6 day visit to the United States, said “We ask you, in your compassion, to bring healing to those who, because of their presence here that day, suffer from injuries and illness. Heal, too, the pain of still-grieving families and all who lost loved ones in this tragedy.” Obviously it was a very emotionally charged moment and, if nothing else, reminded New Yorkers that there are many victims who are still suffering and haven’t been helped by the government. Amazingly still, that same government has squandered millions of dollars of taxpayer money to lawyers and bureaucrats defending the city from lawsuits brought by those injured by the toxins permeating the air after Ground Zero.

The Pope’s visit and call for help for those rescue workers who were injured or disabled was much appreciated. New York Police Commissioner Ray Kelly noted that “it means a lot to the first responders, and it means a lot to the city.” It definitely does, but at the Pope’s side as he delivered those words was Mayor Michael Bloomberg who is ultimately responsible for how the WTC Captive Insurance Fund is run. He too has taken the stance that protecting the city’s interests is ultimately more important than protecting those who sacrificed their health, and in some cases lives, for the city as well. It is a perverse paradox and nothing captures it better than the image of the Pope, calling for healing for those who “suffer from illness and injury,” and Bloomberg, whose decision making has led to the very predicament facing the rescue workers today, standing together. Considering how great this injustice has ended up being; we may finally be seeing the tide begin to turn.

As I’ve noted, there is some good being done towards correcting the unforgivable way these heroes have been treated. There are renewed calls for setting up a Victim’s Compensation Fund with the money remaining. Of course this is what should have been done with the $1 Billion initially allocated by Congress in the first place, but at least it might expedite the process for the rescue workers to get the money they are entitled to. The House Judiciary Committee hearings were also a big step in the right direction. After it became apparent that the health of the rescue workers was compromised, everyone in Congress promised to help the rescue workers in the same way that they promised to help the families of the victims who died in the plane crashes and in the World Trade Center. But almost 7 years later when those rescue workers weren’t receiving the money that had been set aside for them, at least Congress held hearings and drew attention to the problem and promised action. Granted, this will take time, but I know I feel better knowing that the federal government is aware of the problem and are trying to take some action while the city’s government worries about protecting itself from a lawsuit.

April 1 House Hearings Begin With Issa Controversy

On April 1, the House Judiciary Committee hearings that finally began to shed some political light on the abominable $1 billion WTC Insurance Fund that has managed to deny WTC rescue workers money as Michael Bloomberg and Christine LaSala have worked with the very dollars designed to help those endangered by the toxins of Ground Zero, to ensure that New York City is free from being sued instead of helping those who deserve it began. Almost immediately, things were overshadowed by California Republican Representative Darrell Issa who claimed that the attacks of 9/11 were “simply a plane crash” while implying that the federal government had given enough money to a situation that was, in Issa’s view, essentially New York state’s problem. True, the federal government had given $1 billion and created the WTC Insurance Fund, but anyone who has been following this blog knows how well that has turned out. Issa stated that “I have to ask … why the firefighters who went there and everybody in the city of New York needs to come to the federal government for the dollars versus this being primarily a state consideration.” Obviously the answer to that question lies in the fact that those within New York State in charge of the WTC Insurance Fund have done a horrible job in helping the WTC rescue workers.

As I’ve been exploring this problem, I was first struck by the callousness of Christine LaSala and how she ran the WTC Insurance Fund and her lack of compassion for the WTC rescue workers. Then as I’ve begun to realize that Michael Bloomberg is a bigger part of the problem than I first realized, I was shocked that the Mayor of the city that endured the nation’s largest terrorist attack would be so concerned with using the WTC Insurance Fund to protect his interests from liability from lawsuits. Now, I see that maybe too much time has passed and that there is a general callousness across this nation towards the rescue workers who have become ill and died in many cases. Certainly the media has barely paid attention to the WTC Insurance Fund’s mismanagement and the plight of those it was supposed to serve. It seems that many people such as Issa and Bloomberg have reached a point where they feel that a lot of money has (rightfully) gone to those who died in the plane crashes and in the twin towers and that the work there is mostly done.

Plus with the economy nearing a recession and the war being a huge burden on the federal government’s spending ability; some feel that 2001 is far enough in the past that this is a New York state health problem as opposed to something the nation should galvanize behind. And it could’ve been something New York State could have solved if Bloomberg, LaSala, and their WTC Insurance Fund cronies were more concerned with people’s health than lawsuit protection. Still, judging by the harshness of his comments, Issa immediately backpedaled when he realized his comments were political suicide. He retracted the statements and offered his concern for all affected by the attacks and admitted he was just trying to ask tough questions about the federal funding that’s going to New York.

Bloomberg’s Panel Offers Real Solutions

As I stated last time, Michael Bloomberg, sadly five years after 9/11 and two years after FEMA created the WTC Insurance Fund, appointed his own World Trade Center Health Panel to analyze the after effects of the city’s efforts to help the WTC rescue workers who had been living in varying degrees of illness ever since. I’ll leave aside for a second the fact that upon becoming elected in 2002, one would logically assume that a full investigation of these issues would be one of the first steps a new mayor would take if he were running a city dealing with the aftermath of the nation’s largest terrorist attack. Instead he callously defended Christine LaSala and the WTC Insurance Fund until enough pressure was raised by state and federal representatives angered at the thought of $1 Billion being used not to help those it was earmarked for, but to fight against the WTC rescue workers claims. I won’t rehash my last post and some of the World Trade Center Health Panel’s findings that indict the way the WTC Insurance Fund has been run, but I will show you the most damning evidence yet that shows the mismanagement and, arguably, corruption exercised by Bloomberg and those who run the WTC Insurance Fund.

The WTC Health Panel, remember Bloomberg’s handpicked crew set to analyze the WTC Insurance Fund, came forth with the following recommendation. “that Congress re-open the Victim Compensation Fund (VCF) so that victims can quickly get fair compensation for injuries suffered as a result of the 9/11 terrorist attacks. At the same time the VCF is re-opened, the report says Congress should eliminate the liability of the City and its contractors for claims arising out of the clean-up at the World Trade Center and, since the World Trade Center Captive Insurance Company (WTC Insurance Fund) would no longer be needed, Congress could also liquidate the insurance company and put its $1 billion into the re-opened VCF. The new proposal would use federal money to compensate claims without the need to prove fault on the part of the City, its contractors or anyone else and would eliminate the delay and expense inherent in litigation. The re-opened Victims Compensation Fund would address those individuals who couldn’t seek its help before the Fund’s closure in December 2003.”

Is this not the solution that concerned members of Congress, New York city residents concerned about the health of their neighbors, and everyone other American citizen who has heard the health horror stories of the WTC rescue workers is seeking from the WTC Insurance Fund and it’s $1 Billion endowment? And this recommendation was made over a year ago and yet Christine LaSala, while retiring this year, is still earning $350,000 running the WTC Insurance Fund and Michael Bloomberg is still concerned about potential liability from lawsuits rather than reopening this Victim’s Compensation Fund and acting on this panel’s recommendations. Bloomberg’s handpicked panel has even agreed that Congress should alleviate liability of the City and contractors in order to expedite paying those whose health is deteriorating while this plays out in courts and in Washington D.C. This was always Bloomberg and LaSala’s main defense of their cavalier handling of the WTC Insurance Fund. Most telling in the WTC Health Panel’s recommendation that the WTC Insurance Fund (as run by Captive Insurance Company) would no longer be needed and that the $1 billion (or what’s left of it after La Sala and the attorneys she hired to fight these claims got their share) could immediately be used to compensate claims without having to prove fault on the part of the city. This, to me, is a key point. Both Christine LaSala and Michael Bloomberg have stated that the problem facing the WTC Insurance Fund is that all of these lawsuits are contingent upon finding fault with the city itself. The WTC rescue workers aren’t looking to sue the city they valiantly tried to help out of spite (despite what Bloomberg seems to intimate about the need for the WTC Insurance Fund to protect the city’s interests); they need help to cover their mounting health expenses. This panel is saying that Congress should immediately alleviate this worry and proceed with actually helping those who helped this city recover and dissolve the WTC Insurance Fund and begin helping the rescue workers recover like they helped the city recover.

Congress Shows Some Outrage at the Wtc Insurance Fund

As I mentioned in my last post, one of the most disturbing things about the Christine LaSala/WTC Insurance Fund fiasco is the amazing lack of coverage in the mainstream media and reaction by the government. As noted, Michael Bloomberg, the mayor of the city that suffered the worst terrorist attack on American soil has taken Christine LaSala’s side by arguing that it’s necessary to use the $1 Billion that Congress granted for the WTC rescue workers to fight their claims before paying them. Fortunately for those sick and dying, not everyone in our government is on the side of Christine LaSala and the WTC Insurance Fund. Last August, the Chairman of the Senate Judiciary Committee, Patrick Leahy of Vermont, and ranking member Arlen Specter of Pennsylvania inquired with Christine LaSala about the same questions I’ve been trying to answer in this blog. Along with New York’s senators, Chuck Schumer and Hillary Clinton, finally Congress began to take some action against the inefficiency and disingenuousness of the WTC Insurance Fund and had called out Christine LaSala by name. Part of their letter included the following

As the Chairman and Ranking Member of the Senate Judiciary Committee, we are interested in learning how and when the 9-11 clean up volunteers and workers will receive the $1 billion in tax payer money Congress appropriated for their injuries. Because we are considering calling for a hearing on this matter during the month of September, a prompt response would be appreciated.

Politics tends to move at a slow pace, but finally that hearing has come on April 1st of this year. That is a victory for the WTC rescue workers who are still agonizingly without the money that our government promised them and that Christine LaSala is using from the WTC Insurance Fund to fight against them. Nonetheless, Christine LaSala faced with proposed hearings in front of the United States Senate has still arrogantly refused to appropriate any funds to the rescue workers that are entitled to them. During this time, of course, Christine LaSala has continued to collect her $350,000 annual salary and $20,000 worth of health benefits. Within Leahy and Specter’s letter are even more troubling figures. They write that $74 million of the $1 billion has been spent on overhead and legal costs since Congress appropriated the funds for the WTC Insurance Fund. Considering this letter was written last fall, this number is probably now approaching $100 million or 10% of what was earmarked for the WTC Insurance Fund to be doled out to the WTC rescue workers. It’s maddening to think that it has taken two US Senators to bring Christine LaSala’s mismanagement to the attention of the American people. The mainstream media, including the New York papers, outside of a few examples have completely ignored this story leaving Americans unaware of what Christine LaSala is doing with their tax dollars and not doing for their fellow citizens. Even Mayor Bloomberg, who was elected by the people most affected by 9/11, hasn’t been advocating an inquiry into Christine LaSala’s management of the WTC Insurance Fund. He has chosen to argue that Congress intended the money to be used to verify the validity of the claims rather than as a victim’s compensation fund. Well, judging by the letters from two noted Congressman as well as the April 1 hearing, it’s safe to say that he’s mistaken.

Christine Lasala & Michael Bloomberg: Strange Political Bedfellows

As much as I’ve discussed Christine LaSala’s reprehensible behavior in handling theWTC Insurance Fund there is a ton of blame to go around when we consider that $1 Billion has been denied to WTC rescue workers who are sick and dying. As I initially stated, the goal of this blog was to raise public outrage to try to get government officials to fire Christine LaSala or, ideally, find a new organization to administer the funds to the WTC rescue workers. But even Mayor Michael Bloomberg has taken to defending Christine LaSala and the manner in which the WTC Insurance Fund is being run. He continues to present such a defense as the heroes who rushed into Ground Zero without hesitation suffer from emphysema, assorted other respiratory problems, and even cancer.

Bloomberg was quoted in a CBS News article about the growing sentiment concerned about Christine LaSala’s management of the $1 Billion. Bloomberg stated “they just don’t know the facts. The truth of the matter is, Congress didn’t set up a victims’ compensation fund,” the mayor said. “We’d like them to do that, we’ve asked for that, they set up a captive insurance company. And the insurance company can only pay out monies if somebody sues us in court and wins a judgment against us.” Examining what Bloomberg has said is interesting because he is basically endorsing Christine LaSala to use the $1 Billion to defend against lawsuits made by sick WTC rescue workers or the families of those whose loved ones had died. And such a stance by Bloomberg is so appalling as he basically states that the first priority of the money that Congress immediately earmarked for the WTC Insurance Fund was to vet these cases as opposed to helping those that would be in much better health today had they received care when this money was approved as opposed to possibly 2015 when Christine LaSala expects to begin paying from this fund. And, of course, it can’t be mentioned enough that Christine LaSala will be earning $350,000 per year while those who suffer wait.

For Michael Bloomberg to essentially take the stance that WTC rescue workers will only get paid if they beat Christine LaSala’s team of lawyers (lawyers financed by that $1 Billion) in court. And then for Bloomberg to take the stance that “the insurance company can only pay out moneys if somebody sues us in court and wins in judgment against us” is the worst of all. Christine LaSala and the WTC Insurance Fund can pay out whoever they wish. Congress approved this $1 Billion because Americans were horrified by 9/11 and felt for the rescue workers who helped NYC recover. If Christine LaSala began helping those who were suffering without fighting every case in court I highly doubt Congress will be investigating. Instead by fighting the heroic WTC rescue workers and being highly compensated while spending the money on these cases, Christine LaSala and the WTC Insurance Fund are being investigated by Congress.

Is the Media Afraid of Christine Lasala and the Wtc Insurance Fund?

A general theme that I’ve tried to make over the last several posts is that not only are Christine LaSala and the WTC Insurance Fund squandering the $1 Billion they were granted by Congress and negligently allowing the health of WTC rescue workers to deteriorate, but also that the media has hardly reported these events. Certainly the inner workings of complex tort litigation isn’t the first thing that people want to read in the morning paper, but with the memories of 9/11 so fresh in the minds of all Americans, but especially New Yorkers, you would think more attention would be paid to the plight of the rescue workers and of the WTC Insurance Fund and how Christine LaSala has run it.

Instead, Christine LaSala has essentially gotten a pass from the mainstream media as she has siphoned $350,000 per year from the WTC Insurance Fund and paid countless millions to other attorneys to try to deny the claims of the WTC rescue workers that the WTC Insurance Fund was designed to assist. As I mentioned, thanks to the good work of the law firm of Napoli & Bern on behalf of the WTC rescue workers, on April 1 Congress will be holding hearings to inquire into how Christine LaSala has been managing the WTC Insurance Fund. Besides the publicity that Napoli & Bern have received for defending these American heroes, there have been a scant few reporters who have been investigating this story since the beginning. Susan Edelman of the New York Post has written a number of stories that paint a clear picture of how little the WTC rescue workers have received, especially in comparison to how much money Christine LaSala has “earned” from the WTC Insurance Fund. Her story from the fall of 2006 (http://www.nypost.com/...nalnews/350g_paycheck_for_citys_9_11_scrooge_regionalnews_susan_edelman.htm) really illustrates the sham that Christine LaSala is perpetrating in the name of the WTC rescue workers. Besides Edelman who’s written a couple of stories, recently Napoli & Bern were featured in the New York Times coinciding with this week’s hearings in Washington D.C. It is my hope that the Times’ piece and these hearings raise some public consciousness of what Christine LaSala has been doing (or mostly not doing).

However, a few newspaper articles and a Congressional hearing won’t be at the forefront of the media’s attention with an upcoming election and a possible recession. Because of this, Christine LaSala can continue to earn well over a quarter-million dollars per year and fight against the WTC rescue workers unchecked. Beyond the inherent media issues, I think part of the problem is that many New Yorkers have been eager to put the awful memories of 9/11 out of their minds and presume that all the promises made by the likes of Giuliani, Bloomberg and those in the federal government were kept. Sure we hear stories on the news every night about individuals with serious health problems after working at Ground Zero, but the money that was designated for these victims has vanished under Christine LaSala’s watch and the average New Yorker is unaware of that. It’s a fraud so audacious that the media and public have basically ignored the story because it’s so hard to believe that after the tragedy of 9/11 that so many taxpayer dollars could be misspent.

On April 1, Napoli & Bern Brings This Problem in Front of Congress

As I mentioned a few days ago, the law firm of Napoli & Bern (www.877wtchero.com) is doing good work at trying to help WTC rescue workers recover some of the $1 billion that Congress set aside for those that risked their lives amid the debris immediately after 9/11. One of Napoli & Bern’s greatest achievements was setting up a hearing six days from now (April 1) in front of the Judiciary Committee in Congress. Napoli & Bern’s goal at this hearing is to show the poor health of some WTC rescue workers and to exhibit the embarrassing incompetence of Christine LaSala and WTC Captive Insurance Fund. To the naked eye this seems like a cut and dry case. Napoli & Bern can parade a cavalcade of witnesses who saw the tragedy of 9/11, decided they wanted to help, and suffered horrible health problems such as occupational asthma, chronic bronchitis, asbestosis, mesothelioma, silicosis, emphysema, cancer, and various other respiratory illnesses.

Hopefully Congress can think back to 9/11 and how we all felt and will see these heroes who now have chronic health problems and aren’t being helped by a government that promised they wouldn’t let them down. Of course Christine LaSala and the WTC Captive Insurance Fund will counter Napoli & Bern’s points by arguing that each case requires due diligence so that the fund isn’t ripped off by rescue workers filing specious claims. It sounds like a tough fight until we realize that a lot of these rescue workers are already receiving some disability payments from the city (but not nearly enough to cover the astronomical medical bills that arrive from treating these chronic conditions). So what Christine LaSala is arguing against Napoli & Bern is that these WTC rescue workers are sick enough to receive disability payments from the city, but it’s still questionable if they are eligible to receive any of the $1 Billion that Congress set aside for these very individuals.

In fact LaSala and the WTC Captive Insurance Fund have basically admitted that it may be 2015 before a lot of this money is dispersed and during that time chunks of the $1 billion will be used to pay Christine LaSala’s outrageous salary and health benefits while WTC rescue workers wait as their health deteriorates further. This is what Napoli & Bern is fighting. In fact, Napoli & Bern is arranging for victims to be transported to Washington to energize support and raise awareness for this cause. Remember, despite what Christine LaSala tries to imply, these are not opportunistic charlatans trying to take advantage of our country’s good will and generosity after this tragedy. Napoli & Bern’s clients are regular New York men and women who saw the horror of 9/11 and wanted to pitch in anyway they could and now have no way of dealing with the health problems that have arisen. Hopefully on April 1 we will see the beginnings of change that will allow these heroic men and women to receive the help they need to improve their health. Please alert everyone you know about what Napoli & Bern is doing and make sure that Congress is held accountable also. It’s great to approve $1 Billion aid for these rescue workers, but Congress must also oversee the use of these funds so they aren’t squandered by Christine LaSala. Hopefully soon, I’ll have an interview with a representative of Napoli & Bern and give you more information about what they are trying to accomplish.

April 1st Hearings Illustrate Both Sides of Fund Issue

After examining the House of Representatives’ hearing regarding aid for World Trade Center rescue workers and the WTC Insurance Fund it appears that there are two sides at war over this issue. On one side, we have the usual proponents of how the WTC Insurance Fund has been run that I’ve been discussing over the last several weeks. Christine LaSala has demonstrated compassion for workers beyond being able to spend $100 million, of the $1 billion Congress granted the WTC Insurance Fund, on outside attorneys that are fighting the claims of the rescue workers. Worse yet, we have Michael Bloomberg, Mayor of our city, who has sided with LaSala and how the WTC Insurance Fund has been run. Of course, being Mayor he has the power to institute changes on behalf of the rescue workers, but has chosen to remain cloaked behind a defense of the WTC Insurance Fund that centers upon protecting the city from lawsuits.

Last time, I spoke about Darrell Issa (R-CA) who made comments at these hearings that basically stated that the health of the rescue workers was New York State’s problem and that the federal government had done enough by creating the WTC Insurance Fund. A statement incredibly offensive to New Yorkers, but indicative of how time has managed to make so many people forget how many others made sacrifices on and after 9/11. Beyond those three, a new player has emerged towing the line of defending the city against lawsuits. Michael Cardozo, the New York City Corporation Counsel, who is essentially the city’s top legal officer has stated “This is ten thousand individual people with very different and complex facts that all have to be sorted out.” He has snidely adds “I would certainly prefer to be able not to fight with the people who came out heroically to help clean up Ground Zero. I’m charged, of course, with a duty, and the city must defend itself.” Of course while he is performing that duty, thousands that were healthy pre 9/11 are now suffering while these cases are “sorted out.” And again, that’s a big part of the problem, since the legal process is a slow one and people are only getting worse as the WTC Insurance Fund sits untapped except when used for the city’s defense.

On the other side, New Yorkers are fortunate to have Representative Jerrold Nadler whose efforts got this case in front of the House in the first place. And while we haven’t seen immediate results, having the issue back in the public eye is preferable to the backroom dealings of Bloomberg and LaSala and the WTC Insurance Fund. We also have Ken Feinberg who ran the Victim’s Compensation Fund for those died in the plane crashes and the towers. He has volunteered and been championed by many to resume such a title and use the WTC Insurance Fund, not as a defense for the city, but as a VCF for WTC rescue workers. The tireless efforts of the law firm Napoli & Bern have raised New Yorkers’ awareness of how their fellow neighbors have been mistreated by the system and the WTC Insurance Fund. Ironically enough, Darrell Issa and his heartless statements may end up doing more harm than good. By generating as much outrage (and subsequent press coverage) as he did there are many more citizens now wondering why these hearings are being held and why the heroes who helped clean up Ground Zero are not being compensated by the WTC Insurance Fund for illnesses and death. As this continues to play out, slowly unfortunately, we’re starting to see the transparent loyalties of both sides in dealing with the WTC Insurance Fund.

LaSala, Bloomberg, and Cardozo are most concerned with using the WTC Insurance Fund as a defense for the city from lawsuits. Nadler (as well as State Senators Schumer and Clinton), Napoli & Bern, and Feinberg have the interest of the people at heart; not using federal taxpayer dollars as a mechanism for the city to protect itself.

The Goals of the Petition and How You Can Help Against the Wtc Insurance Fund

As I mentioned a few posts ago, I set up a petition at www.wtccaptivefund.com to achieve two goals. First, I wanted to exert enough pressure on the New York government to replace the inefficient Christine LaSala from being in charge of the WTC Insurance Fund. Second, I wanted some accountability from our elected officials in finding alternatives to the WTC Insurance Fund which has already spent nearly 10% of the $1 Billion it has been allocated by Congress to deliver to the injured and dying. No other entity, public or private, could do less with $1 billion than Christine LaSala and the WTC Insurance Fund have. It’s impossible to do less than pay one claim in nearly four years while spending nearly $100 million of the $1 billion that Congress has given to the WTC Insurance Fund. That is the point of this blog and this petition (www).

One of the most infuriating things about the WTC Insurance Fund is the combination of how much 9/11 resonates with all Americans and yet how little attention this story has received. We are consistently reading in the paper about the failing health of those who worked around the Ground Zero area immediately after 9/11. We hear very little about the WTC Insurance Fund at all; even less about how the WTC Insurance Fund has failed to pay those that are suffering and dying. It’s as if the media takes the story to a certain point (i.e. the WTC rescue workers are in bad health) but not to the end (the WTC Insurance Fund has $1 Billion that should be used to help these victims, but is being squandered in fighting their cases). That’s also the point of the petition: raising awareness. In today’s viral dominated society maybe Americans will start forwarding this petition (www) to their families and friends and the numbers will get large enough that some inquiry into the WTC Insurance Fund takes place. Even if only the mainstream media catches onto the WTC Insurance Fund story I think it will be a victory for the WTC rescue workers that we are trying to help. And there is no question that the rescue workers need our help.

The WTC Insurance Fund is a monolith and has already demonstrated that they have no problem delaying payment to those in need until 2015. If this petition speeds up that process by a day then we’ll have done our job. If Christine LaSala is removed from the head of the WTC Insurance Fund one day sooner we’ll have done our job. Even if this story just gets picked up by a major newspaper or TV station we’ll have done our job. To me, this is what the WTC rescue workers deserve. Not only money obviously, but the respect of having their story told and the support of citizens galvanized beyond them. The WTC Insurance Fund would prefer to keep the story in the past and leisurely work at denying claims while their CEO Christine LaSala earns 350K and her underlings squander the money Congress gave them to manage. Christine Lasala and the Mismanagement of the Wtc Captive Insurance Company

As mentioned, Christine LaSala and the WTC Captive Insurance Company have done a disgraceful job at managing the $1 billion that was designated to help ill rescue workers and those who helped clean up the WTC site. Out of that money, nearly $27.3 million has been spent by Christine LaSala since 2004 to pay for outside lawyers to help WTC Captive Insurance Co. fight the cases being presented by the rescue workers. So the money of New York taxpayers, who thought they were helping their fellow citizens, has been used by Christine LaSala to fight those WTC rescue workers who risked a lifetime of good health to help the city recover after 9/11.

As a New Yorker this is quite upsetting to me since I saw firsthand, the devastation of this tragedy and I expected both the state and the WTC Captive Insurance Company to do better for the WTC rescue workers. But that hasn’t happened and despite the words of a few elected officials such as Chuck Schumer, Christine LaSala remains in power to manage the WTC Captive Insurance Fund and fight against the interests of those who care about this city and its residents as opposed to making a profit. This fraud that has been perpetrated against this city has also gone largely unreported by the media even though we keep hearing about how poorly the health of the WTC rescue workers is. But judging by the money that the WTC Insurance Fund has to work with and how much Christine LaSala herself is being paid, it’s tragic to think how much good isn’t being done for our neighbors. It has been reported that the WTC Captive Insurance Fund may not start paying claims of the injured and dying WTC rescue workers until 2015 because they are fighting each of these cases, all the while Christine LaSala is making $350,000 per year and the WTC Insurance Fund is spending sometimes upwards of $20M per year on lawyers to fight these cases.

In some cases, the state is paying disability for these injured WTC rescue workers, but so much taxpayer money has been wasted by Christine LaSala since 2004 and during that time she’s made over $1M and the WTC Captive Insurance Fund has been completely inefficient. What can be done about LaSala and the WTC Rescue Workers Fund? I am hoping to draw attention to this problem and cast a spotlight on Christine LaSala and the WTC Captive Insurance Fund and hopefully get enough citizens angry enough that the government takes action. It is a slow fight, but I think if the average New Yorker knew the fraud that was going on with their tax dollars they would call for Christine LaSala to be fired and the WTC Captive Insurance Fund to be turned over to a company that is more interested in the health of its citizens than lining their pocketbooks.

Behind the Scenes at the Wtc Insurance Fund

As I’ve noted in prior posts, one of the enduring hypocrisies facing the WTC rescue workers awaiting payment for inhaling toxic fumes amidst the rubble after 9/11 is that the WTC Insurance Fund, led by Christine LaSala, is using its mandate to fight the claims of those who need the money the most. It has been noted that tens of millions of the $1 billion that Congress handed over to the WTC Insurance Fund, to be distributed to WTC rescue workers, have instead been used to pay to outside law firms to fight the claims of those sick and dying from exposure to these toxins.

One of the most ruthless attorneys employed by the WTC Insurance Fund is James Tyrrell of the law firm Patton Boggs best known for defending the company that manufactured Agent Orange. Knowing what we now know about Christine LaSala and the WTC Insurance Fund and their corporate ethics, I’m certain he fit right in. And during the time he’s been working with the WTC Insurance Fund, he and other attorneys have managed to take $47 million of the $1 billion that Congress earmarked for paying WTC rescue workers. That means nearly 5% of the entire WTC Insurance Fund, designed to help those American heroes dying from emphysema and lung cancer after helping us recover from the most significant attack on US soil, have been spent on high priced attorneys fighting against the same plaintiffs the WTC Insurance Fund was supposed to defend. And during that time… only $45,000 has been paid out to one carpenter who fell off a ladder. If that wasn’t enough to boil the blood, lawyer Thomas Jones who serves as the WTC Insurance Fund’s secretary is also a partner at McDermott & Will law firm, which serves as the WTC Insurance Fund’s legal counsel. That is an obvious conflict of interest since McDermott & Will advises the WTC Insurance Fund on what they can and cannot legally do with the $1 Billion they have while at the same time one of their partners is working for the company they are representing. McDermott & Will can defend their man while he works within the WTC Insurance Fund denying claims for injured fire, police, and civilians.

A scandal involving so much money related to a topic so near and dear to hearts of all Americans, but especially New Yorkers, would normally be front-page news, but in this case it’s barely been touched by mainstream media. Between Tyrrell, Jones, and the other lackeys hired by Christine LaSala and the WTC Insurance Fund, $75 million has been spent fighting the claims of the WTC rescue workers. Putting yourself in the shoes of these heroes you realize what horrible odds they face as they are outspent (ironically with their own tax dollars used against them) and are in poor health. Worse yet, as we’ve seen the WTC Insurance Fund has stated that they may be looking at 2015 until money begins being paid. Christine LaSala (making $350,000 annually) and her cronies are quite rich and can afford to wait for this fight to take place. Can a fireman living off a small disability check with rising health costs afford to do the same?.

In fact, it could put you in an awful position. These type of words fall into two categories, which are:

1) The Plead Message

"Amy, please, please call me. This is the 4th time I have called. I really have to talk to you."

2) The Emergency Message

"Amy, this is an emergency. Please call me as soon as you get this."

Now, you are using here the power of both curiosity and self interest. Amy could not resist it! Her mind wondering about many things she did, and asking hersellf: "What did I do?", "What does he appreciate from me?" But, it makes her feel good because your message is a positive one.

However, even if this technique is really powerful, it is very important that you have thought carefully of a plan, which is, figuring out what your ex girlfriend did to you that you told her you appreciate. It can be any small thing, but needs to be really credible.

The Rights of Men

Being a woman, nobody suspects me of being sympathetic towards the plight of men. And before you ask, yes, there is such a thing as the plight of men. And I don't mean “men” in the “all of mankind” way either. I mean men, actual men, boys, males, whatever you wish to call them. Many of of us may be ignoring it, but the fact of the matter is that Feminism has turned society into something that has become disadvantageous to its more masculine half. I mean sure, men are still regarded as more successful when put in positions of authority. But in reaction to feminism, I must say that issues that are pertinent to women are being given precedence over issues that are pertinent to men.

Before we continue with that discussion, I would like to explain exactly why I am sympathetic towards the rights of men. I am a sister to a very responsible, very sweet young man who has a very bright future. He occasionally has temper, but he is otherwise far too nice for his own good. I live in fear that this innate kindness and sense of responsibility would attract the wrong sort of people – the sort of people who will try to take advantage of him by, I don't know, maybe trying to foist a child he did not father into his responsible arms. I'm sure that isn't happening any time soon of course, as my brother is quite focused on his job (which is thankless and low-paying I must say; he deserves a better one) and working at a DNA laboratory, I'm sure he could prove that the baby isn't his.

But I believe my point stands: there are men who can be taken advantage of too, and there aren't enough laws that would protect them from it. And even if there WERE laws, we have been brainwashed into thinking that all men are scum and are more likely to accuse the men of doing something wrong even if it has been proven otherwise. I am not quite sure if I want to live in a world where one gender is favored over the other. Especially when there are so many good young men that I know who are not protected by the law simply by virtue of being men.

Another thing that I worry about is this: a stigma about men being verbally, economically, emotionally and physically abused by a woman is written off and laughed at by law enforcement officers. Laughed at! It's as if men cannot be exploited at all when we all know that men are just as human as women, as just as susceptible to cruelty. Most men and boys who are abused emotionally are afraid to come forward, as opposed to women who (while frightened themselves) are publicly encouraged to step forward and tell their stories. It is incredibly sad how broken men are not given the same public encouragement. It's becoming increasingly obvious that men and boys are being taught that they have no right whatsoever to be hurt, or express being in pain.

I have also noticed that when a couple gets divorced, it is more often than not the mother who is given full custody of the children – possibly under the assumption that the male half of the couple does not have the skills or tools to bring up his own children. Again, as a young woman who knows a lot of decent young men, this observation is quite alarming. I may not be contesting the idea that women are more prone to being victims of assault and other crimes against my gender, but I also get the sinking feeling that the laws have become lopsided in favor of protecting the women and not just protecting everyone.

I will become a mother someday, and the thought that this will not change by the time any son of mine grows up makes me feel anxious about the future. Something, I believe, must be done.
